On January 1, 2014, the law in Colorado surrounding spousal support changed. Before that time spousal support was determined based upon one party’s ability to pay it and the other parties need for it. Because we have so many different counties in Colorado, this led to very different support amounts in different counties. The Colorado State legislature wanted things to become a bit more uniform so they introduced a spousal maintenance formula. This can be problematic because some people think that the formula is a guarantee, but it is just a suggestion. There are lots of different factors that go into a spousal maintenance order. The formula is just one place to look. Different judges treat the formula differently.
